ASBO for Southall OAP
by court reporter
A Southall pensioner made subject of an 'ASBO' for constantly playing his radio loudly in the corridor of his sheltered accommodation, has spent four months in prison and lost his home.
But despite neighbours complaining he made their lives "a misery",
Garib Dass, 65, who made his neighbours' lives a 'misery' was released today (Friday) after a judge reduced his 260 day sentence to 'time served' at Isleworth Crown Court.
Dass had a flat at Cheviot Court in St Mary's Avenue, and had lived there for three years when he was made subject of an anti-social behaviour order by Ealing Magistrates in February.
Prosecutor Caroline Hughes said: "The order was not to harass or distress any employee or visitor to the flats, not to cause excessive noise and not be drunk or abusive towards other residents."
In June he breached the order by "causing a number of problems."
Ms Hughes added: "His flat is often without electricity so he leaves the front door open to get light from the corridor and plays his portable radio very loudly in the corridor. He plays it into the early hours of the morning and it echoes down the corridor. Several residents complained, one saying 'He makes my life an absolute misery.'"
Police were called in June and pointed out the ASBO to which he replied "Yes, I know."
Dass, who has 22 previous convictions for 51 offences including harassing his neighbours, admitted breaching the ASBO.
Sentencing him, Judge Sam Katkhuda said: "The ASBO is there for a purpose Ð to stop you annoying your neighbours. If you keep breaching that order it will be a serious matter because you will be defying a court order and it will result in imprisonment".
